A provider builds or substantially modifies an AI system and puts it on the market. A deployer uses an AI system under its own authority in a professional context. Most B2B SaaS companies are deployers — for example, using a third-party AI tool to screen candidates — and deployers carry their own obligations for human oversight, monitoring, and record-keeping.
Does the EU AI Act apply to US companies?
It can. The Act has extraterritorial reach where the output of an AI system is used in the EU. Separately, EU and US buyers are increasingly adding EU AI Act questions to their vendor security reviews regardless of where you are based.
What happens on August 2, 2026?
